Artem Sokurov, Counsel, advised a European client on the preparation to and obtaining of a force-majeure certificate from the Ukrainian Chamber of Commerce and Industry. The force-majeure circumstances consisted of the introduction of a ban on grain import from the territory of Ukraine to an EU country and of the implementation by Ukraine (via JSC “Ukrainian Railways”) of a mirror conventional ban on the transportation of grain to this EU country from the territory of Ukraine by railways, which overall prevented the client from duly and timely performing its obligations under a grain supply contract. The client is a key European player in the grain processing industry.
